Who needs a Lasting Power of Attorney?

If you were to lose Mental Capacity and/or Physical Capacity either permanently or temporarily, who would look after your affairs?

This is exactly what Lasting Powers of Attorneys are used for. These important Legal Documents are essential for anyone 18 years and above. Loss of capacity can affect anyone. Age has absolutely nothing to do with it.

Illness, injuries and accidents aren’t age discriminate and can happen when you are young and healthy. Do not assume that your loved ones, no matter how closely related or connected to you could act on your behalf. It doesn’t matter if you are married, in a civil partnership or if they are your Next of Kin, they would not automatically have the authority to deal with your Bank Account(s), pay your Mortgage or any other financial obligations for you. They would not have the authority to assist in making decisions on your behalf in respect of your Healthcare & Welfare such as what Care and Medical Treatment you would wish to receive.

What does it mean if I haven’t put my Lasting Powers of Attorneys in place?

  • I will do it later as I’m mentally sound right now….
    If you haven’t put your Lasting Powers of Attorneys in place and your Mental Capacity is lost, the opportunity to get these important documents in place will have been lost as you MUST have mental capacity to do these legal documents.
    The only avenue open to you once Mental Capacity has been lost is for your Family to apply to the Court of Protection for a Deputyship order. This process involves a very lengthy court case with extortionate legal fees.
  • So, should I do it in a few years when I’m a bit older?
    The short answer is – NOW!! If you haven’t made your Lasting Powers of Attorneys, then do it now while you have the Mental Capacity to legally do so. A Persons Mental Capacity can be lost at ANY TIME!
